MyRacing Terms of Service

Welcome to MyRacing. These Terms of Service ("Terms") govern your access to and use of the MyRacing web application (app.myracing.online) and mobile applications (iOS and Android), collectively referred to as the "Service." By accessing or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.

1. Definitions

"Service" refers to the MyRacing web application and mobile applications, including all features, content, and functionality provided.

"User," "you," or "your" refers to any individual who accesses or uses the Service.

"We," "us," or "our" refers to MyRacing and its operators.

"Content" refers to all data, information, text, graphics, and other materials uploaded, downloaded, or appearing on the Service.

"User Data" refers to data you input into the Service, including but not limited to session records, motorcycle setups, tire information, lap times, and related racing data.

2. Account Registration and Security

2.1 Account Creation

To use certain features of the Service, you must register for an account. When registering, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You may register using your email address and password, or through third-party authentication providers such as Google Sign-In.

2.2 Account Security

You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2.3 Age Requirements

You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Service Description and License

3.1 Service Description

MyRacing provides motorcycle racing data management tools, including but not limited to: session tracking and analysis, motorcycle setup management, tire management with manufacturer catalogs, lap time recording and comparison, spare parts inventory, maintenance tracking, endurance race strategy planning and pit stop optimization, AI-powered racing assistance (Pro subscription required), weather integration, and data sharing with mechanics and team members.

3.2 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal use related to motorcycle racing activities, or professional use by mechanics and team managers supporting riders.

3.3 Restrictions

You may not: (a) sublicense, sell, resell, transfer, assign, or distribute the Service; (b) modify or make derivative works based on the Service; (c) reverse engineer or access the Service to build a competitive product or service; (d) use the Service for any unlawful purpose or in violation of any applicable laws; (e) share your account credentials with third parties; (f) use automated systems or software to extract data from the Service ("scraping").

4. Subscription Plans and Payment

4.1 Free Plan

The Free Plan is provided at no cost with the following limitations:

  • 1 motorcycle
  • Up to 5 saved setups per motorcycle
  • Up to 10 document uploads
  • Up to 50 tires tracked
  • Up to 5 spare parts tracked

Free Plan includes: session tracking and comparison, tire and setup management, maintenance tracking, spare parts inventory, endurance race planning, and basic analytics.

4.2 Paid Plans (Pro)

Pro subscription plans provide additional features including:

  • Unlimited motorcycles
  • Unlimited setups and documents
  • AI Racing Coach with personalized analysis and recommendations
  • Advanced analytics and performance trends
  • Data sharing with mechanics and team collaboration
  • Setup comparison tools

Pricing and specific features are displayed on the subscription page within the Service.

4.3 Payment Terms

Payments are processed securely through Stripe, our third-party payment processor. We do not store your full credit card details on our servers. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days advance notice.

5. User Data and Content

5.1 Ownership

You retain all rights to your User Data. We do not claim ownership over any content you submit, post, or display on or through the Service.

5.2 License to User Data

By submitting User Data to the Service, you grant us a worldwide, non-exclusive license to use, store, process, and display such data solely for the purpose of providing and improving the Service.

5.3 Data Backup

While we implement reasonable measures to protect your data, you are responsible for maintaining your own backups of User Data. We are not liable for any loss of User Data.

6. Intellectual Property

The Service, including its original content (excluding User Data), features, and functionality, is and will remain the exclusive property of MyRacing. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

The Service includes tire manufacturer catalogs and track databases provided for your convenience. These databases may include trademarks and data belonging to third parties. Such third-party content is included solely to enhance the user experience and does not imply endorsement.

7. Third-Party Services and Links

The Service integrates with and may contain links to third-party services, including:

  • Stripe (payment processing)
  • Google (authentication via Google Sign-In)
  • AI service providers (for AI Racing Coach functionality)
  • Weather data providers
  • Track day organizers and external resources

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of such third-party services.

8. AI Racing Coach Disclaimer

8.1 Nature of AI-Generated Content

The AI Racing Coach feature uses artificial intelligence technology to provide recommendations, suggestions, and information related to motorcycle racing. This feature is available to Pro subscribers and is powered by AI models that process general racing knowledge and user-provided data.

8.2 Limitations and Accuracy

AI CAN BE WRONG. You acknowledge and understand that: (a) AI-generated responses may contain errors, inaccuracies, or outdated information; (b) the AI does not have access to real-time conditions at your track or knowledge of your specific motorcycle's condition; (c) recommendations regarding tire pressures, suspension settings, gearing, and other technical parameters are general suggestions that may not be appropriate for your specific situation; (d) the AI cannot account for your personal skill level, physical condition, or experience; (e) AI responses are generated automatically and are not reviewed by human experts before being displayed to you.

8.3 User Responsibility

USE YOUR OWN JUDGMENT. You are solely responsible for: (a) critically evaluating all AI recommendations before applying them; (b) verifying any technical information with qualified professionals, official manuals, or authoritative sources; (c) making your own informed decisions about motorcycle setup, riding technique, and safety; (d) consulting professional coaches, mechanics, or instructors for personalized advice; (e) understanding that no AI system can replace proper training, experience, and professional guidance.

8.4 Not Professional Advice

The AI Racing Coach does NOT provide: professional coaching or instruction; certified mechanical advice; safety certifications or approvals; medical or health-related guidance; or legal advice. Any information provided should be treated as general educational content only.

8.5 Assumption of Risk

BY USING THE AI RACING COACH, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: (a) you will use common sense and your own expertise when evaluating AI suggestions; (b) you will not blindly follow AI recommendations without independent verification; (c) you assume all risks associated with implementing any AI-generated suggestions; (d) MyRacing, its creators, and operators shall not be liable for any injuries, damages, losses, accidents, or death resulting from your use of or reliance on AI-generated content; (e) motorcycle racing is inherently dangerous and AI recommendations do not make it safer.

9. Disclaimers and Limitation of Liability

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Racing Activity Disclaimer

Motorcycle racing is an inherently dangerous activity. The Service provides data management tools only and does not guarantee improved performance or safety. You assume all risks associated with motorcycle racing and track day activities. We strongly recommend appropriate safety equipment, professional instruction, and adequate insurance.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYRACING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (D) ANY BUGS, VIRUSES, OR THE LIKE THAT MAY BE TRANSMITTED THROUGH THE SERVICE; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR €100, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless MyRacing and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any User Data you submit to the Service.

11. Termination

11.1 Termination by You

You may terminate your account at any time using the account deletion feature in your Profile settings. Upon termination, your right to use the Service will immediately cease and all your data will be permanently deleted.

11.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your User Data after a reasonable period following termination. You may request export of your data before termination in accordance with applicable law.

12. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in Poland.

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MyRacing regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
